These terms explain the conditions for using our website and artist portal. Please read them before using our services.
Purchases are governed by our separate Terms and Conditions of Sale. Artist submissions, exhibitions, artwork storage and other programme activities are subject to the participation terms provided for the relevant service.
Our Privacy Policy explains how we handle personal information. Cookie choices are managed through our website’s cookie settings.
2. Copyright and intellectual property
Copyright and other intellectual property rights in the website’s artwork images, photographs, text, logos, design and other content belong to Auto Amor or the relevant artists, photographers and other rights holders.
You may browse the website and download or print reasonable extracts for your personal, non-commercial use. Please retain any copyright notices and artist credits.
You may share links to our pages. Except where permitted by law or expressly authorised, you must not reproduce, alter, distribute, sell or commercially exploit website content without permission from the relevant rights holder.
Buying an artwork does not transfer its copyright.
3. Acceptable use
You must use the website and portal lawfully and respect the rights of other people.
You must not:
Attempt to access another person’s account or information without permission.
Introduce malicious software or interfere with the website’s operation or security.
Submit fraudulent, misleading, unlawful or rights-infringing material.
Use the website to harass others or send unsolicited advertising.
Collect artists’ or customers’ personal information for unsolicited contact or marketing.
Use automated tools to extract content or data without permission, except where permitted by law.
4. Artist accounts
When using an artist account, please provide accurate information and keep relevant details up to date.
Keep your login details secure and do not share access with anyone who is not authorised to manage your account. Contact info@autoamor.co.uk if you suspect unauthorised access.
An internal record created from a board purchase or previous submission does not automatically mean that you have activated an artist account or joined a new programme.
Having an account or uploading work does not guarantee selection, exhibition, promotion or sale. Any exhibition commitment, including participation in New Arrivals, is governed by the relevant participation terms.
5. Information and artwork you upload
You retain ownership of your artwork and any copyright you hold in the material you upload.
You must own the material or have the permissions needed to upload it and allow us to use it for the service you request. This includes photographs, artwork images, biographies and other supplied content.
You give us a non-exclusive permission to store, copy, resize and display that material only as reasonably necessary to operate your account and provide the submission, exhibition, discovery or sales services you have requested or agreed to.
Authorised hosting and technical providers may process the material on our behalf for those purposes.
Uploading material does not automatically make it public. Public display, curator access and promotional use depend on the service you join, the applicable participation terms and any permissions required. Optional artist portraits and interviews are handled separately.
Please do not upload another person’s private information without an appropriate reason and permission where required.
You can contact us to request correction or removal of uploaded material. We will explain any effect on an ongoing exhibition or sale and any records we need to retain. Our Privacy Policy explains how this applies to personal information.
6. Website information and availability
We take reasonable care to keep website information accurate and up to date. Please contact us if you spot an error.
Artwork availability, events and programme information may change. We will deal with errors or changes affecting an accepted order under our Terms and Conditions of Sale. These website terms do not allow us to disregard an existing contractual commitment.
We may temporarily restrict access for maintenance, updates or security reasons. Where practical, we will give notice of significant planned interruptions.
Please keep your own copies of uploaded images and other important material.
7. External websites
Our website may contain links to websites operated by artists, partners and other organisations.
Those websites have their own terms and privacy policies. A link does not necessarily mean that we endorse the website or its content. We do not control third-party websites, but this does not exclude responsibility where the law makes us responsible.
8. Restricting access
We may restrict an account or remove material where reasonably necessary to address a breach of these terms, protect users or systems, investigate suspected misuse or comply with the law.
Our response will be proportionate to the circumstances. Where appropriate, we will explain the reason and give you an opportunity to respond. We may act immediately where there is an urgent security or legal concern.
Restricting website access does not remove your rights relating to purchases, artist payments or artworks held by us. Those matters remain governed by the relevant agreement and applicable law.
9. Our responsibility to you
We do not exclude or limit liability where doing so would be unlawful. This includes liability for fraud, fraudulent misrepresentation, or death or personal injury caused by our negligence.
If you are a consumer, we are responsible for foreseeable loss or damage caused by our breach of these terms or failure to use reasonable care and skill. Loss is foreseeable if it is an obvious consequence or was contemplated by both parties when the relevant agreement was made.
Nothing in these terms affects your statutory consumer rights or our obligations under data protection law.
Responsibility for goods you purchase is addressed in our Terms and Conditions of Sale.
10. Changes to these terms
We may update these terms to reflect changes in the website, our services or legal requirements. We will update the date above.
Where a change materially affects an ongoing portal service, we will notify affected users in advance and obtain agreement where required.
Changes will not retrospectively alter an accepted purchase or participation agreement without an appropriate legal basis or your agreement.
11. Questions and disputes
Please contact info@autoamor.co.uk with questions or complaints about the website or portal.
These terms are governed by English law. Consumers elsewhere retain any mandatory legal protections and rights to bring proceedings in their home courts that apply to them.
